Arizona Child Visitation And Support Attorney

It is of the utmost importance that you work with an attorney who has experience with both general Arizona laws applicable to child custody and visitation and support. A.R.S. §25.411 (B), (C) and (D) are the specific subsections of Arizona law governing military child custody/parenting time. Together, they govern how deployment affects custody, specifically in terms of its effect on the welfare of the child.

The Hague Convention Treaty, which governs service of process overseas, is applicable if the military member is stationed overseas. Mr. Montoya has experience assisting clients in Germany, Mexico, Japan and Spain, where the Hague Convention is strictly adhered to. The use of Form USM-94, which governs requests for service abroad of judicial or extrajudicial documents by the U.S. Marshals, is also absolutely necessary.

What Is Included In Determination Of Child Support Payments?

A.R.S. §25-320 governs the calculation and payment of child support under Arizona law and is also relevant to child support calculation and payments by a parent who is a member of the military.

Specifically, in addition to your base pay (as reported on your LES), your BAS/BAH (housing and sustenance allowances) and if relevant, the COLA (cost of living adjustment for personnel stationed in a foreign country based on the exchange rate at the time of payment) will be taken into account when calculating child support.

Mr. Montoya can also assist with property division in a military divorce.
